For what purposes will we treat your personal data?

We will process the information provided by patients in order to facilitate the provision of the health services requested, the administrative and billing management derived from them.

Images obtained from video surveillance cameras will only be used for the purpose of security and surveillance of these facilities.

 

How long will we keep your data?

Law 41/2002, of 14 November, the basic law regulating patient autonomy and the rights and obligations regarding clinical information and documentation, establishes the obligation to keep clinical records for a minimum of 5 years from the date of discharge from the last healthcare process. This regulation must be complemented with the provisions of the applicable community regulations. In the event of other community regulations that establish the obligation of periods longer than 5 years, this period shall be taken into account for the conservation of the data. Likewise, they shall be kept for the time necessary to be able to meet possible civil liability claims.

What is the legal basis for the processing of your data?

The legal basis for the processing of your data is the fulfilment of a legal obligation based on the terms and conditions set out in Law 14/1986, of 25 April, General Health Law, in Law 41/2002, of 14 November, the basic law regulating patient autonomy and rights and obligations regarding clinical information and documentation, as well as any regional regulations that may be applicable. Commercial offer of products, services or discounts is based on requested consent, without in any case the withdrawal of this consent conditioning the execution of the service provided. Sending reminders of appointments or periodic check-ups to the patient by any other means (telephone/mail/SMS/messaging apps) is necessary to satisfy the legitimate interest of the data controller. Likewise, your personal data may be used for: sending congratulations, publication of images on the website, exhibition of images at congresses or courses, exhibition of images in scientific publications and sharing of images with other professionals as a clinical study case, if you have previously given your consent, without the withdrawal of this consent conditioning the provision of the health service requested.

To which recipients will your data be communicated?

The data will be communicated to prosthesis laboratories for the manufacture of customised medical prostheses, to tax offices that carry out tax procedures for us, to computer maintenance companies, to self-employed professionals who work in our facilities, to insurance companies in the event that we have arranged medical assistance insurance for the purpose of invoicing health care expenses and to public administrations for compliance with legal obligations.

What are your rights when you provide us with your data?

Patients have the right to obtain confirmation as to whether or not we are treating personal data concerning them. Patients have the right to access their personal data, as well as the right to request the rectification of inaccurate data or, where appropriate, to request its deletion when, among other reasons, the data is no longer necessary for the purposes for which it was collected. In certain circumstances, patients may request the limitation of the processing of their data, in which case we will only keep it blocked for the exercise or defence of claims. In certain circumstances and for reasons related to their particular situation, patients may object to the processing of their data, in which case we will no longer treat the data, except for compelling legitimate reasons, or the exercise or defence of any claims.
